Understand the Facts Before a Divorce Becomes More Complicated

Divorce can become one of the most difficult phases of a person’s life. When a marriage starts facing serious problems, couples may have questions about separation, mutual consent divorce, ex-parte divorce, maintenance, hidden information, or the financial circumstances of a spouse.

The biggest problem is that people often try to find answers through friends, social media, google searches, whatsapp groups, or incomplete advice. A statement that sounds correct may not actually apply to every matrimonial case.

This is why understanding the facts before taking a major step is important. In some situations, divorce detectives in India can also help with lawful fact-finding and verification when there is a genuine concern about information that may be relevant to a matrimonial dispute.

However, investigation and legal advice are different things. A detective can help with investigation-related matters, while a qualified family lawyer should advise you about your legal rights, court proceedings, and available remedies.

Mutual Consent Divorce: Is Two Years of Separation Really Required?

Another common question is about the separation period for mutual consent divorce.

People often hear statements such as: “Mutual divorce ke liye do saal separate rehna padta hai.”

But this should not be treated as a universal rule. For marriages governed by the Hindu Marriage Act, 1955, Section 13B provides that the parties must have been living separately for one year or more, must not have been able to live together, and must have mutually agreed to dissolve the marriage. The provision also contains a separate timeline relating to the second motion.

Therefore, saying that every couple must simply wait for two years before mutual consent divorce would be inaccurate. The actual legal position can depend on the marriage, applicable law, circumstances, and court process.

What if the couple lived together for only a few months?

This is another situation where people should avoid one-line answers.

Suppose a couple got married but lived together for only two or three months before separating. That fact may be relevant to understanding the matrimonial circumstances, but it does not mean that divorce automatically happens because they lived together for a short period.

The applicable legal requirements still have to be considered. This is why professional legal advice is important before making assumptions about the divorce process.

Can a Working Wife Still Claim Maintenance?

This is one of the most common questions in matrimonial disputes.

Many people believe: “Agar wife job karti hai, toh woh maintenance kaise maang sakti hai?”

But the answer is not that simple. A wife having an income does not automatically mean that a maintenance claim must fail. The Supreme Court has recognised that the fact that a wife is earning does not, by itself, prevent a maintenance claim; the court can consider whether her income is sufficient and examine the circumstances of the case.

At the same time, this does not mean that every working wife will automatically receive maintenance. The court can consider relevant financial circumstances, income, needs, liabilities, and other facts. This is why financial information can become important in matrimonial disputes.

If there is a genuine dispute about employment or income, lawful verification may sometimes help establish relevant facts. The legal significance of those facts, however, should be assessed by a qualified lawyer.

Common Mistakes People Make During Divorce

One of the biggest mistakes people make is believing everything they hear about divorce.

Assuming Ex-Parte Means Automatic Divorce

Some people think that if their spouse does not attend court, they automatically win the case. This is not how the process should be understood.

Believing a Working Wife Cannot Claim Maintenance

A wife’s employment does not automatically end every possible maintenance claim. Courts can examine whether her income is sufficient and consider the circumstances of the case.

Believing Two Years’ Separation Is Always Required

The separation requirement depends on the applicable law. For Section 13B of the Hindu Marriage Act, the statutory requirement refers to one year or more of living separately.

Making Serious Allegations Without Evidence

Calling something “fraud,” “cheating,” or “concealment” does not automatically establish the legal position.

Collecting Evidence Through Illegal Methods

People sometimes become desperate to prove something and attempt hacking, unauthorised access to accounts, impersonation, or other unlawful methods.

This can create additional problems.

Relying Only on Social Media

Every matrimonial case has different facts. A short video or social media post cannot replace case-specific legal advice.

Why You Should Not Take a Major Divorce Decision on Half-Knowledge

Divorce can affect your finances, family relationships, children, property, and future. That is why it is risky to make an important decision based only on something you heard from a friend or saw in a social media video.

For example:

“Wife working hai, toh maintenance nahi milega.”

“Two years separation compulsory hai.”

“Spouse court mein nahi aaya, toh divorce automatically mil gaya.”

“Illness hide hui hai, toh fraud automatically prove ho gaya.”

These statements may sound simple, but actual matrimonial law is more complicated.

The better approach is to understand the facts, preserve genuine information, and take professional advice.

How Rahul Rai Gupta and Professional Investigation Can Help

Rahul Rai Gupta has experience in the field of private investigation and matrimonial matters.

Where investigation is legally and ethically appropriate, professional investigators can assist with fact-finding, verification, matrimonial investigation, documentation, and other investigation-related requirements.

However, investigation is not a substitute for a lawyer.

If your issue involves divorce proceedings, maintenance, legal rights, or interpretation of law, you should consult a qualified legal professional.

The investigator can help you understand what the facts are, while the lawyer can help you understand what those facts may mean legally.

This difference can be extremely important in a matrimonial dispute.

A Useful Resource for Learning More

For readers who are interested in investigation and want to understand more about the professional side of detective work, How to Become Detectives, recently published by Detective Guru Publications™, can be explored as an additional educational resource.

The book can be useful for readers who want to learn more about investigation, detective work, and the professional aspects of this field.

The larger message is simple: before taking a major step in a matrimonial dispute, understand the facts instead of relying on assumptions.
